Despite pervasive variation in the content of laws, legal theorists and anthropologists have argued that laws share certain abstract features and even speculated that law may be a human universal. In the present report, we evaluate this thesis through an experiment administered in 11 different countries. Are there cross‐cultural principles of law? In a between‐subjects design, participants (N = 3,054) were asked whether there could be laws that violate certain procedural principles (e.g., laws applied retrospectively or unintelligible laws), and also (...) whether there are any such laws. Confirming our preregistered prediction, people reported that such laws cannot exist, but also (paradoxically) that there are such laws. These results document cross‐culturally and –linguistically robust beliefs about the concept of law which defy people's grasp of how legal systems function in practice. (shrink)

As moral injury is a still-emerging concept within the area of military mental health, prevalence estimates for moral injury and its precursor, potentially morally injurious events (PMIEs), remain unknown for many of the world’s militaries. The present study sought to estimate the prevalence of PMIEs in the Canadian Armed Forces (CAF), using data collected from CAF personnel deployed to Afghanistan, via logistic regressions controlling for relevant sociodemographic, military, and deployment characteristics. Analyses revealed that over 65% of CAF members reported exposure (...) to at least one event that would be considered a PMIE. The most commonly PMIEs individuals reported included seeing ill or injured women and children they were unable to help (48.4%), being unable to distinguish between combatants and non-combatants (43.6%), and finding themselves in a threatening situation where they were unable to respond due to the rules of engagement under which they were required to operate (35.4%). These findings provide support for both the presence of exposure to PMIEs in CAF members and the need for formal longitudinal data collection regarding PMIE exposure and moral injury development. A growing body of research has examined how people judge the persistence of identity over time—that is, how they decide that a particular individual is the same entity from one time to the next. While a great deal of progress has been made in understanding the types of features that people typically consider when making such judgments, to date, existing work has not explored how these judgments may be shaped by normative considerations. The present studies demonstrate that normative beliefs do (...) appear to play an important role in people's beliefs about persistence. Specifically, people are more likely to judge that the identity of a given entity remains the same when its features improve than when its features deteriorate. Study 1 provides a basic demonstration of this effect. Study 2 shows that this effect is moderated by individual differences in normative beliefs. Study 3 examines the underlying mechanism, which is the belief that, in general, various entities are essentially good. Study 4 directly manipulates beliefs about essence to show that the positivity bias regarding essences is causally responsible for the effect. (shrink)

This paper presents an attempt to integrate theories of causal processes—of the kind developed by Wesley Salmon and Phil Dowe—into a theory of causal models using Bayesian networks. We suggest that arcs in causal models must correspond to possible causal processes. Moreover, we suggest that when processes are rendered physically impossible by what occurs on distinct paths, the original model must be restricted by removing the relevant arc. These two techniques suffice to explain cases of late preëmption and other cases (...) that have proved problematic for causal models. (shrink)

We argue that there is a tension between two monistic claims that are the core of recent work in epistemic consequentialism. The first is a form of monism about epistemic value, commonly known as veritism: accuracy is the sole final objective to be promoted in the epistemic domain. The other is a form of monism about a class of epistemic scoring rules: that is, strictly proper scoring rules are the only legitimate measures of inaccuracy. These two monisms, we argue, are (...) in tension with each other. If only accuracy has final epistemic value, then there are legitimate alternatives to strictly proper scoring rules. Our argument relies on the way scoring rules are used in contexts where accuracy is rewarded, such as education. (shrink)

People more frequently select norm-violating factors, relative to norm- conforming ones, as the cause of some outcome. Until recently, this abnormal-selection effect has been studied using retrospective vignette-based paradigms. We use a novel set of video stimuli to investigate this effect for prospective causal judgments—i.e., judgments about the cause of some future outcome. Four experiments show that people more frequently select norm- violating factors, relative to norm-conforming ones, as the cause of some future outcome. We show that the abnormal-selection effects (...) are not primarily explained by the perception of agency (Experiment 4). This dissertation is a work in the philosophy of ecology and environmental philosophy. The central aims of the dissertation are to examine the role that ecological concepts and theories play in environmental philosophy, and to defend a conception of ecological science that is broad enough to address the philosophical and scientific concerns of environmental philosophers. As stated, these aims are consistent with the dominant tradition in contemporary environmental philosophy, but the dissertation is highly critical of the way the ecology-environmental philosophy (...) relationship is conceived and theorized in contemporary environmental philosophy. Rather than view ecology as a conceptual and scientific resource that is relevant to environmental philosophy only insofar as it provides support for the ethical, social and political aims of environmentalism, I argue that the core problems of environmental philosophy are essentially problems for a general science and philosophy of ecology, which I define as "the philosophical and scientific study of system-environment relationships". This definition of ecology is broad, but it is not vacuous. A central aim of the dissertation is to defend the robustness of a conception of ecology that is sufficiently broad to encompass "ecological psychology", "ecological economics", and "ecological anthropology", as well as traditional ecological science. ;The dissertation is divided into three parts, with three chapters in Part One, four chapters in Part Two, and two chapters in Part Three. Part One is a survey and critique of the role of ecology in environmental philosophy. Part Two develops a conceptual framework for a general philosophy of ecology based on developments in complex systems approaches in theoretical ecology and ecological psychology. Complexity and complex systems theories play a large role in the argument of the dissertation, and Part Three explores in greater detail certain issues in the foundations of the complex systems sciences that are relevant to a conception of ecological phenomena as complex systems phenomena. L’objection la plus ancienne et la plus redoutable à la démocratie fait valoir que le gouvernement par le peuple dessert le gouvernement pour le peuple. Les citoyens manquant pour la plupart de sagesse ou de compétence, le bien commun serait mieux assuré en confiant le pouvoir à un individu éclairé ou à une élite experte. Une réponse commune à cette objection concède la prémisse mais affirme la priorité au gouvernement par le peuple sur le gouvernement pour le peuple : le (...) droit égal à la participation devrait l’emporter sur la promotion de la compétence, même si celle-ci est requise par le bon gouvernement. La démocratie se trouve alors réduite à un ensemble de procédures équitables, traitant les citoyens en égaux ; elle ne se définit plus par la poursuite du bien commun. Il est toutefois une autre réponse à l’objection, qui évite cette dérive vers un procéduralisme étroit. Elle consiste à nier la prémisse et à affirmer la sagesse politique du peuple. Il n’est pas vrai que le gouvernement pour le peuple serait mieux assuré en confiant le pouvoir à un petit nombre de sages ou d’experts, fussent-ils les meilleurs parmi les citoyens. Cette thèse remarquable peut paraître improbable. Sa défense peut pourtant s’appuyer sur l’un des arguments les plus intrigants élaborés par la philosophie politique aristotélicienne, qui inspire et éclaire les controverses philosophiques contemporaines sur la valeur du régime démocratique : l’argument de la sagesse de la multitude. Les multiples liens entre la réalité historique et l’anthropologie philosophique qui ont fasciné les philosophes depuis Hegel jusqu’à Dilthey, Heidegger, Adorno et Habermas – l’évolution historique, les dimensions historiques de l’éthique, de la politique, l’histoire de l’individu et les deux (...) philosophèmes qu’elle englobe : la Vie et la Mort – y sont singulièrement absents, absents tout court (pas dans le sens parisien du mot). Le problème de l’induction (humien) a récemment été abordé par Steel dans son article de 2010. Celui-ci soutient que les théories d’apprentissage formelles permettent de justifier logiquement le principe de l’induction, ce dernier assurant la fiabilité logique des méthodes. Cette proposition a été critiquée par Howson en 2011, ce dernier mettant en doute la possibilité même qu’une méthode puisse être logiquement fiable. Bien que Steel ait offert une réponse à cette critique, il n’y répond pas directement. Dans le présent article, (...) une réponse frontale à celle-ci est offerte en s’inspirant des pratiques de tests d’hypothèses en sciences biologiques. Pour ce faire, une règle de construction des ensembles d’hypothèses est proposée, règle offrant une justification logique au fait qu’une méthode convergera nécessairement vers la vérité. Cet amendement étant cohérent avec l’ensemble de la proposition de Steel, il est ainsi possible d’affirmer que sa thèse est renforcée par cette proposition. (shrink)

Le modèle unificationniste de l’explication métaphysique, basé sur les travaux de Kitcher sur l’explication scientifique, offre une alternative intéressante aux modèles présumant la conception supportive de l’explication métaphysique [backing model]. Par contre, le caractère adéquat de ce modèle, i.e. sa capacité à classifier comme métaphysiquement explicative/non-explicative des propositions qui préthéoriquement sont classés comme tel, n’a pas encore été exploré. Pour ce faire, des interprétations pour les relations de détermination et d’appartenance à un ensemble sont fournies. Celles-ci étant potentiellement sujette au (...) problème d’artificialité, i.e. présence d’un biais structurel favorisant l’attribution du caractère explicatif, une réponse est offerte. En effet, le modèle unificationniste permet d’identifier les patrons argumentatifs pouvant être légitimement mis en compétition en comparant la distance entre les ensembles de faits qui doivent être considérés comme vrais dans la formulation d’un patron argumentatif. Cette propriété a des conséquences intéressantes dans l’identification du niveau adéquat de débat entre des propositions compétitrices. (shrink)

Que les récits utopiques et contre-utopiques sont-ils censés nous apprendre que nous ne sachions déjà – que l'état du monde pourrait être meilleur, ou pire, qu'il n'est ? Qu'ont-ils à nous dire de la sanction pénale, comme concept et comme pratique, et que celle-ci nous apprend-elle en retour des limites de l'utopie comme récit et comme discours ? En mettant l'accent sur les références explicites, dans 1984, à la suppression systématique de tout ce qui pourrait ressembler à une règle, et (...) en resituant le roman dans le contexte social et colonial de l'expérience orwellienne de l'injustice pénale, cet article montre que les lectures d'Orwell inspirées de Rorty, Foucault et Deleuze, et centrées sur les notions de pouvoir, de discipline et de contrôle, manquent en partie leur objet. Ni simple « satire », ni « prophétie », ni « expérience de pensée », 1984 exprime la grammaire profonde de notre conception libérale du droit pénal, comme le dirait Wittgenstein. S'il n'est jamais question pour Orwell de dénoncer l'utopie comme intrinsèquement dangereuse, 1984 révèle toutefois qu'il est impossible d'en saisir l'élément de perfection par le droit. En ce sens, la « dernière utopie » des droits humains (S. Moyn) n'en est pas une. --- What are we supposed to learn from utopian/dystopian fiction – beyond the obvious fact that the state of the world could be better, or worse ? What can these fables tell us about criminal penalty as a concept and as practice ? Conversely, what can punishment tell us of the limits of utopia as a tale and as discourse ? By stressing 1984's explicit references to the meticulous elimination of anything vaguely resembling a rule, while putting the novel in the perspective of Orwell's social and colonial experience of penal injustice, this paper shows that interpretations of Orwell inspired by the likes of Rorty, Foucault or Deleuze, which are grounded on power, discipline or control, somehow miss their target. No mere “satire” nor “prophecy”, nor even “thought experiment”, 1984 expresses the deep-seated grammar of our liberal conception of penal law, as Wittgenstein would put it. While Orwell aims in no way to dismiss utopia as intrinsically dangerous, 1984 however shows that the element of perfection it contains cannot be grasped by law. In this respect, the “Last Utopia” of human rights (S. Moyn) is certainly not one. (shrink)

The status of philosophy is contingent upon the civilizations that embrace or undermine its importance. Such status is never fully understood, nor clear, due in part to its inutility. In a goal-oriented world, philosophizing is pointless if it does not produce material results. One point of philosophy though is not only to recognize, but promote activities which are uniquely human and which therefore artificial intelligence could not possibly simulate. Improvisation, as one such activity, can reveal the importance of philosophy as (...) a discipline by maintaining the relevance of subjectivity. In order to justify the presence of philosophy in the university, one important way is to have philosophy maintain the notion that the mental cannot be reduced to the material or physical. Consequently, phenomenology in philosophy’s defense becomes more relevant the more we realize that philosophy is threatened by the interdependency of materialism, A.I. research, and the corporatization of the university. Past research on folk aesthetics has suggested that most people are subjectivists when it comes to aesthetic judgment. However, most people also make a distinction between good and bad aesthetic taste. To understand the extent to which these two observations conflict with one another, we need a better understanding of people's everyday concept of aesthetic taste. In this paper, we present the results of a study in which participants drawn from a representative sample of the US population were asked whether (...) they usually distinguish between good and bad taste, how they define them, and whether aesthetic taste can be improved. Those who answered positively to the first question were asked to provide their definition of good and bad taste, while those who answered positively to the third question were asked to detail by what means taste can be improved. Our results suggest that most people distinguish between good and bad taste, and think taste can be improved. People's definitions of good and bad taste were varied, and were torn between very subjectivist conceptions of taste and others that lent themselves to a more objectivist interpretation. Overall, our results suggest that the tension Hume observed in conceptions of aesthetic taste is still present today. (shrink)

This paper challenges the philosophical assumption that bodily sensations are free from normative constraints. It examines the normative status of bodily sensations through two studies: a corpus-linguistic analysis and an experimental investigation. The corpus analysis shows that while emotions are frequently subject to normative judgments concerning their appropriateness, similar attitudes are less evident towards bodily sensations like feelings of pain, hunger and cold. In contrast, however, the experimental study reveals notable differences in conceptions of bodily sensations. It finds that sensations (...) of hunger and cold are occasionally subject to normative assessment, with about half of the participants considering it reasonable to assess these sensations normatively. L’une des fonctions des institutions publiques des démocraties libérales est de formuler des recommandations à l’attention des décideurs. Or, les institutions publiques savent que leurs recommandations seront souvent ignorées en partie par le décideur. Cette situation de « conformité partielle » aux recommandations soulève plusieurs problèmes de nature philosophique pour les institutions. En nous appuyant sur une analyse de 570 recommandations tirées de 40 documents et rapports du secteur public québécois, nous identifions deux enjeux entourant la structure des recommandations issues (...) du secteur public. This article explains Kant’s claim that sciences must take, at least as their ideal, the form of a ‘system’. I argue that Kant’s notion of systematicity can be understood against the background of de Jong & Betti’s Classical Model of Science (2010) and the writings of Georg Friedrich Meier and Johann Heinrich Lambert. According to my interpretation, Meier, Lambert, and Kant accepted an axiomatic idea of science, articulated by the Classical Model, which elucidates their conceptions of systematicity. I show that (...) Kant’s critique of the mathematical method is compatible with his adherence to this axiomatic conception of science. I further show that systematicity furthers traditionally accepted logical ideals of scientific knowledge, which explains why Meier and Kant think that sciences must be ‘systematic’. (shrink)

Unabhängig von der Bestimmung der Wahrheit als Korrespondenzbeziehung wollten sie herausfinden, inwieweit zur Erklärung der Wahrheit von Sätzen besondere Entitäten herangezogen werden müssen. Einige dieser Entitäten, so zum Beispiel Bolzanos ‘Sätze an sich’, Freges ‘Gedanken’ oder die ‘propositions’ von Russell und Moore, wurden als Träger der Eigenschaften Wahrheit und Falschheit aufgefaßt. Einige Philosophen jedoch, wie Russell, Wittgenstein im (...) ›Tractatus‹ und Husserl in den ›Logischen Untersuchungen‹, argumentierten, zusätzlich zu den Wahrheitsträgern bzw. an ihrer Stelle müßten Entitäten angenommen werden, auf Grund deren Sätze und/oder ‘Propositionen’ wahr sind. Solchen Entitäten gab man verschiedene Namen, insbesondere ‘fact’, ‘Tatsache’, ‘state of affairs’ und ‘Sachverhalt’. 1 Wir wollen einer Entscheidung über die Angebrachtheit dieser Ausdrücke nicht vorgreifen und daher zunächst eine neutralere Terminologie verwenden: Alle Entitäten, die für diese zweite Rolle in Frage kommen, wollen wir ‘Wahrmacher’ nennen. Abstact : This article provides a critical examination of David Estlund’s epistemic proceduralism. Epistemic proceduralism suggests a promising way to justify democracy without renouncing the pursuit of truth. By making the legitimacy and authority of democratic institutions dependent on their general tendency to produce good decisions, rather than on the correctness of their results or on their mere procedural fairness, it shows that they can to be connected to substantial standards, such as justice, without ignoring the persistence of moral disagreements. (...) By subjecting political procedures to a dual requirement, both epistemic and egalitarian, it suggests that a mixed conception of the value of democracy can be articulated. But by refusing to take sides on the nature of truth, on the choice of the relevant substantial standard, or on the moral theory defining the constraints that equal respect imposes on the choice of political procedures, epistemic proceduralism fails in my view to offer a convincing defence of democracy. In order to explain what makes democracy valuable, a philosophical conception must take a position on the nature of truth, justice and equality. -/- Résumé : Cet article propose une relecture critique du procéduralisme épistémique élaboré par David Estlund. Cette théorie suggère une voie prometteuse pour justifier démocratie sans renoncer à la poursuite de de la vérité. En proposant de faire dépendre la légitimité et l’autorité des procédures démocratiques de leur tendance générale à produire de bonnes décisions, plutôt que de la justesse constante de leurs résultats ou à l’inverse de leur seule équité procédurale, il montre qu’elles peuvent être reliées à une visée substantielle, telle la justice, sans ignorer pour autant la persistance des désaccords à son endroit. En soumettant ces procédures à une double exigence, à la fois épistémique et égalitaire, il montre qu’une conception mixte de la valeur de la démocratie est concevable. Mais en refusant de prendre parti sur la nature de la vérité, sur le choix du critère objectif devant guider l’évaluation des décisions politiques ou sur la théorie morale permettant d’expliciter les contraintes que l’égal égard dû aux personnes impose au choix des procédures, le procéduralisme épistémique s’interdit de construire une justification convaincante de la démocratie. Are psychiatric disorders natural kinds? This question has received a lot of attention within present-day philosophy of psychiatry, where many authors debate the ontology and nature of mental disorders. Similarly, historians of psychiatry, dating back to Foucault, have debated whether psychiatric researchers conceived of mental disorders as natural kinds or not. However, historians of psychiatry have paid little to no attention to the influence of (a) theories within logic, and (b) theories within metaphysics on psychiatric accounts of proper method, and (...) on accounts of the nature and classification of mental disorders. Historically, however, logic and metaphysics have extensively shaped methods and interpretations of classifications in the natural sciences. This paper corrects this lacuna in the history of psychiatry, and demonstrates that theories within logic and metaphysics, articulated by Christian Wolff (1679-1754), have significantly shaped the conception of medical method and (psychiatric) nosology of the influential nosologist Boissier De Sauvages (1706-1767). After treating Sauvages, I discuss the method of the influential nosologist William Cullen (1710-1790), and demonstrate the continuity between the classificatory methods of Sauvages and Cullen. I show that both Sauvages and Cullen were essentialists concerning medical diseases in general and psychiatric disorders in particular, contributing to the history of conceptions of the ontology and nature of mental disorders. Cet article se propose de tracer les liens théoriques qu’entretiennent l’intelligence artificielle et certaines traditions philosophiques à propos de l’ontologie, du langage, et de l’esprit. On tâchera de mettre en perspective ce en quoi l’intelligence artificielle contemporaine hérite, poursuit, et renouvelle de façon pratique des problématiques anciennes concernant les caractéristiques de l’intelligence humaine et la représentation des connaissances. En introduisant les ontologies informatiques, on cherchera à présenter l’importance des sciences humaines aujourd’hui pour la recherche en intelligence artificielle, tout en soulignant (...) le dialogue permanent que celle-ci a pu entretenir avec la philosophie à travers l’histoire. On conclura en défendant l’intérêt de ces outils pour l’interdisciplinarité des sciences. (shrink)

The three young philosophers Kevin Mulligan, Peter Simons and Barry Smith have become well-known in the last few years especially in German-speaking analytical philosophy and phenomenology circles. This is on the one hand as a result of their historical and systematic philosophical work; but it is also because of the provocative way in which they represent their philosophy. Because they often appear in threes, they have become known as the "gang of three" or "three musketeers" or even – and (...) this in an admiring sense – "mafiosi" (Rescher). They are known primarily for the small workshops they have been organizing in uncomplicated Anglo-Saxon manner all over Europe. Their goal has been to show that analytic philosophy as it has been pursued up to now is in need of reform and also that the history of scientific philosophizing is not identical to the history of Anglo-Saxon analytic philosophy. Above all, they have tried to make more well known the Austrian tradition of scientific philosophy, and they can be given credit for having done much to promote the current interest in this tradition, which means: the history of Austrian philosophy of the 19th and early 20th centuries and its historical context in the Austro-Hungarian Empire. Along with offering an historically-oriented interpretive reconstruction of the syntax of PM ( rst ed.), I argue for a certain understanding of its use of propositional function abstracts formed by placing a circum ex on a variable. I argue that this notation is used in PM only when de nitions are stated schematically in the metalanguage, and in argument-position when higher-type variables are involved. My aim throughout is to explain how the usage of function abstracts as “terms” (loosely speaking) is (...) not inconsistent with a philosophy of types that does not think of propositional functions as mind- and language-independent objects, and adopts a nominalist/substitutional semantics instead. The Racial Contract pone la teoría clásica del contrato social occidental, sin ambages, al servicio de un uso radical extraordinario. Con una mirada arrolladora sobre el expansionismo y el racismo europeos de los últimos quinientos años, Charles W. Mills demuestra cómo este peculiar y no reconocido "contrato" ha dado forma a un sistema de dominación europea global: cómo da lugar a la existencia de "blancos" y "no blancos", personas de pleno derecho y subpersonas, cómo influye en la teoría moral (...) y la psicología moral de los blancos; y cómo este sistema se impone a los no blancos mediante el condicionamiento ideológico y la violencia. Según Mills, el contrato ha proporcionado la arquitectura teórica que justifica toda una historia de atrocidades europeas contra los no blancos, desde las afirmaciones de David Hume e Immanuel Kant de que los negros tenían un poder cognitivo inferior, pasando por el Holocausto, hasta el tipo de imperialismo en Asia que se demostró con la guerra de Vietnam. Mills sugiere que la guetización del trabajo filosófico sobre la raza no es accidental. Este trabajo desafía la suposición de que la teoría dominante carece en sí misma de raza. Al igual que la teoría feminista ha revelado el sesgo invisible de la filosofía política hacia los hombres blancos, la explicación de Mills del contrato racial expone sus fundamentos raciales. Faulkner a bâti une partie de sa renommée sur la violence parfois controversée de ses récits. Mais l’acte criminel retient moins son attention que son contexte et sa signification morale. L’objet premier de la littérature, selon Faulkner, ce sont les conflits de l’homme, ou du cœur humain, avec eux-mêmes. Le propos de cet article est de mettre en évidence la façon dont Faulkner subvertit le modèle du roman noir, et substitue à l’enjeu traditionnel des histoires policières, celui des faits et (...) de l’identité du coupable, un problème moral. Il donne quelques indications sur la structure générale des rapports crime-culpabilité dans l’œuvre de Faulkner, avant de montrer comment cette thématique se décline dans ses « histoires de crime » au sens propre, c’est-à-dire dans L’Intrus (Intruder in the dust, 1948) et Le Gambit du cavalier, et irrigue la reconstitution faulknérienne de la société du Sud et de l’histoire des États-Unis. Aber wo gehört es hin?

This paper aims to uncover some of the important contributions the phenomenological method can offer to philosophical issues in literary studies. It leads us to the idea that the archetypes found in fiction are intuited phenomenologically. This idea is then linked to a social constructive attainment of meaning for reality. From the intersubjectivity provided by phenomenology, empathy with characters in fiction is then displayed as more than an intellectual activity, as it becomes known to have practical implications. It is framed (...) as involving the same processes as the empathy we have with people in the real world. This equivalency allows for the plausibility of the notion that fiction-making is a necessary process for our interpretations of reality. It designates our involvement in fiction as beneficial to our experience of the real world and supports the notion it can train us to empathize. Such training is displayed to be posssible from phenomenology’s role in the process of empathy. Phenomenology's method de-centers the Cartesian ego to prevent any impasse between internal consciousness and the external world. Since they are bridged together by intentionality, we learn that phenomenology is a method that can contribute to how we conceive of empathy. (shrink)

Ce travail examine les revendications contemporaines de droits pour les robots. Il présente les principales formes argumentatives qui ont été développées en faveur d’une considération éthique ou de droits positifs pour ces machines. Il met en relation ces argumentations avec un travail de recherche-action afin de produire un retour critique sur l’idée de droit des robots. Il montre enfin le rapport complexe entre les récits de la modernité et la revendication de droits pour les robots. This article presents contemporary vindications (...) of robot rights. The first part exposes main argumentations in favor of moral consideration or legal personhood for robots. The second part builds on cooperative action research with several French roboticists and experts in order to evaluate these arguments. These dialogues eventually show the complex relationships between the narratives of modernity and the vindication of robot rights. (shrink)

ABSTRACT: GEORGES CANGUILHEM’S BIOPHILOSOPHY The eminent French biologist and historian of biology, François Jacob, once notoriously declared «On n’interroge plus la vie dans les laboratoires»: laboratory research no longer inquires into the notion of “Life”. Certain influential French philosophers of science of the mid‐century such as Georges Canguilhem would disagree, or at least seek to resist some of Jacob’s diagnosis. Not by imposing a different kind of research program in laboratories, but by an unusual combination of historical and philosophical inquiry (...) into the foundations of the life sciences. Canguilhem speaks of «defending vitalist biology» and declares that Life cannot be grasped by logic. Is this history and philosophy of biology? Is it vitalism? It definitely is a different project from current philosophy of biology. One short‐lived term for it was “biophilosophy”. In this paper I explore the content of this term as it relates to the above questions. (shrink)

French translation of "Truth-Makers" (1984). A realist theory of truth for a class of sentence holds that there are entities in virtue of which these sentences are true or false. We call such entities ‘truthmakers’ and contend that those for a wide range of sentences about the real world are moments (dependent particulars). Since moments are unfamiliar we provide a definition and a brief philosophical history, anchoring them in our ontology by showing that they are objects of perception. The core (...) of our theory is the account of truthmaking for atomic sentences, in which we expose a pervasive ‘dogma of logical form’, which says that atomic sentences cannot have more than one truthmaker. The authors uphold the mutual independence of logical and ontological complexity. The theory is compared with that of Wittgenstein’s Tractatus, and the authors outline formal principles of truthmaking taking account of both kinds of complexity and suggesting how to overcome Wittgenstein’s problem of negation. Ernst Mach's atomistic theory of sensation faces problems in doing justice to our ability to perceive and remember complex phenomena such as melodies and shapes. Christian von Ehrenfels attempted to solve these problems with his theory of "Gestalt qualities", which he sees as entities depending one-sidedly on the corresponding simple objects of sensation. We explore the theory of dependence relations advanced by Ehrenfels and show how it relates to the views on the objects of perception advanced by Husserl and by (...) the Gestalt psychologists. Nous proposons une étude de la constitution du sens dans l'interaction humain-machine à partir des définitions que donnent Turing et Wittgenstein à propos de la pensée, la compréhension, et de la décision. Nous voulons montrer par l'analyse comparative des proximités et différences conceptuelles entre les deux auteurs que le sens commun entre humains et machines se co-constitue dans et à partir de l'action, et que c'est précisément dans cette co-constitution que réside la valeur sociale de leur interaction. Il s'agira pour (...) cela de problématiser l'interaction humain-machine autour de la question de ce que signifie « suivre une règle » pour définir et distinguer les modes interprétatifs et les comportements décisionnels de chacun. Nous en viendrons alors au constat que la mutualisation des signes qui s'opère à travers le dialogue humain-machine est au fondement de la constitution d'une société informatisée. (shrink)

L’idéal démocratique est accusé d’être irréaliste. Le gouvernement du peuple par le peuple et pour le peuple serait une chimère dans les sociétés contemporaines. Il faudrait lui préférer les visées plus modestes associées à l’élection : un droit de vote égal et la satisfaction du plus grand nombre. La démocratie ne se laisse pourtant pas réduire à la compétition électorale. Les acteurs et les institutions politiques qui s’en réclament invoquent non seulement un marché, où rivalisent des intérêts privés, mais un (...) forum, où s’affrontent des visions adverses de la justice. Ils attendent de la délibération collective qu’elle serve l’autonomie politique et le bien commun, mais savent aussi qu’elle peut les menacer, lorsque la liberté, l’égalité ou la publicité lui font défaut. Cette enquête philosophique interroge la pertinence de l’idéal démocratique pour des sociétés complexes, dotées d’institutions représentatives et soumises à la communication de masse. Elle montre à quelles conditions cet idéal peut aujourd’hui orienter la critique et l’action. Les citoyens peuvent encore aspirer à se gouverner eux-mêmes, donc à délibérer en égaux. -/- The democratic ideal is accused of being unrealistic. Government of the people by the people and for the people would be a chimera in contemporary societies. The more modest aims associated with election should be preferred: equal suffrage and the satisfaction of the greatest number. But democracy cannot be reduced to electoral competition. The political actors and institutions that claim it invoke not only a market, where private interests compete, but also a forum, where opposing visions of justice confront each other. They expect collective deliberation to serve political autonomy and the common good, but they also know that it can threaten them when it lacks freedom, equality or publicity. This philosophical inquiry questions the relevance of the democratic ideal for complex societies with representative institutions and subject to mass communication. It shows under what conditions a deliberative understanding of this ideal can today orient criticism and action. Citizens can still aspire to govern themselves, hence to deliberate as equals. The inclusion of De astrologia in the Lucianic corpus has been disputed for centuries since it appears to defend astrological practices that Lucian elsewhere undercuts. This paper argues for Lucian’s authorship by illustrating its masterful subversion of a captatio benevolentiae and subtle rejection of Stoic astrological practices. The narrator begins the text by blaming phony astrologers and their erroneous predictions for inciting others to “denounce the stars and hate astrology” (ἄστρων τε κατηγοροῦσιν καὶ αὐτὴν ἀστρολογίην μισέουσιν, 2). The narrator assures (...) readers that he, the knowledgeable astrologer, will correct for the “stupidity and laziness” (ἀμαθίῃ καὶ ῥαθυμίῃ, ibid.) that bring about false predictions. The narrator’s credibility quickly decays when he attempts to recast Orpheus, Bellerophon, Icarus, Daedalus, and a host of other mythological figures as Greek astrologers. Lucian’s audience would expect such far-fetched interpretations of myth from the stereotypical Stoic philosopher, a character lampooned elsewhere in the Lucianic corpus. (shrink)

Schelers Anatomie des Herzens ist neben derjenigen seines Zeitgenossen Shand, die gründlichste, die das zwanzigste Jahrhundert vorzuweisen hat. Sie ist aufs Engste mit einer Ontologie, einer Metaphysik, einer Erkennt- nis- und Wahrnehmungslehre, einer Wert- und Normenlehre, einer Analy- se des Strebens, Überlegens, Wählens und Handelns, einer Sozialphiloso- phie und einer Anthropologie verwachsen. Aufgrund der deskriptive Klarheit und Vielfalt, die sie über weite Strecken auszeichnen, kann sie aber auch unabhängig von diesen Verbindungen betrachtet werden.

Née il y a quatre-vingts ans, la «philosophie continentale» arrive au terme de son parcours. Sa carrière extraordinaire s’est vue favorisée par l’absence presque totale d’intérêt, de la part des philosophes analytiques ou des autres philosophes «exacts», pour ce que le philosophe australien David Stove appelle «la nosologie de la philosophie»2, l’exploration des multiples formes qu’a prises la mauvaise philosophie. Stove indique qu’une telle entreprise implique qu’on fasse de l’histoire. Tout au moins dans un premier temps, la nosologie de la (...) philosophie continentale est inséparable de l’histoire de cette lignée de la philosophie du vingtième siècle, histoire qui clarifierait les rapports historiques et philosophiques entre cette philosophie et la philosophie exacte. Cet article poursuit la réflexion de Dilhac (2014) touchant la relation entre politique et vérité. Au terme d’une analyse de la tolérance chez Mill et Popper, Dilhac conclut qu’une conception épistémique de la tolérance manque sa dimension politique, et qu’il est préférable d’opter pour le concept rawlsien de consensus raisonnable. Discutant ces résultats, le premier objectif est ici de montrer qu’une notion de « raisonnabilité » peut facilement trouver ses racines dans la neutralité scientifique wébérienne, et donc être porteuse d’une (...) dimension épistémique minimale. Le second objectif est de clarifier l’impact de cet argument particulier sur le débat général entourant la démocratie épistémique. Il sera défendu que l’opposition traditionnelle entre les conceptions épistémique et politique de la délibération est à trouver dans un certain perfectionnisme épistémique, mais qu’il existe au moins une conception minimale du potentiel épistémique tout à fait compatible avec les valeurs fondamentales du libéralisme, comme l’inclusion, l’égalité ou la diversité. En d’autres termes, les exigences épistémiques minimales de la neutralité scientifique peuvent être indépendantes du perfectionnisme épistémique. (shrink)
